Terms of Sale

Article 1: Purpose

These terms govern sales concluded between Kevin Lignot (“the Seller”) and any person making a purchase on the site (“the Customer”). Any order implies unreserved acceptance of these Terms of Sale.

Article 2: Product

The product sold is BatteryOnPC, software for Windows 10 / 11 (64 bits) that displays the battery of compatible controllers and peripherals. System requirements: Windows 10 / 11 (64 bits), Aucun (inclus dans l'application). The Customer is invited to check compatibility before purchase (see the FAQ).

Article 3: Price

The price is 5,99 €, as a one-time payment. VAT not applicable, Article 293 B of the French General Tax Code (basic exemption). Prices are net of VAT. The Seller reserves the right to change its prices at any time, it being understood that the price applied is the one in effect at the time of the order.

Article 4: Order

The order is placed online. The Customer selects the product, accepts these Terms of Sale, then proceeds to payment. The sale is deemed concluded after payment confirmation.

Article 5: Payment

Payment is made by bank card via our provider Stripe, on a secure page. No bank card data is collected or stored by the Seller: it is processed directly and exclusively by Stripe, in accordance with industry security standards (PCI-DSS).

Article 6: Delivery

As the product is digital content, delivery is immediate and paperless: a secure download link is made available on the confirmation page as soon as payment is validated, and sent to the Customer's email address. No physical medium is shipped.

Article 7: Right of withdrawal

In accordance with Article L.221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium where performance has begun after the Customer's prior express consent and express waiver of the right of withdrawal.

By validating the order and ticking the relevant box, the Customer expressly requests the immediate supply of the software and acknowledges waiving the right of withdrawal as soon as the download begins. See the refund policy.

Article 8: Legal guarantees

Regardless of any commercial warranty, the Customer benefits from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). Accordingly, if the software has a defect of conformity, the Customer can obtain its repair or, failing that, a refund. To exercise these, contact contact@batteryonpc.com.

Article 9: Liability

The battery levels shown are estimates that depend on the hardware and its protocols; they are provided for guidance only. The Seller cannot be held liable for damage resulting from misuse of the software or unforeseen hardware incompatibility. To the extent permitted by law, the Seller's liability is limited to the amount of the order.

The Seller makes every effort to support as many controllers and peripherals as possible but does not guarantee that 100% of devices are detected or supported: compatibility depends on the hardware, its protocols and its drivers. If a device is not detected, the Customer is invited to contact us. The Seller will do its best to add it or offer a solution.

Article 11: Consumer mediation

In accordance with Article L.612-1 of the French Consumer Code, the Customer may use a consumer mediator free of charge for the amicable resolution of a dispute, provided they have first tried to resolve it directly with the Seller.

Article 12: Governing law

These Terms of Sale are governed by French law. Failing an amicable resolution, the French courts shall have jurisdiction.
